3. AI and Privacy of Your Work

3.1. Privacy and Your Work. The privacy practices regarding your work, such as temporary storage of uploaded documents, are disclosed in this Privacy Policy.

3.2. Mixed Information. Your work may sometimes include your personally identifying information, such as your name, and this personal information is also covered by this Privacy Policy.

3.3. AI Partners. Depending on your request, your work may also be sent to one of our AI Partners for processing, such as OpenAI (maker of ChatGPT), where it is covered by their privacy practices.

3.4. Opt-in. Your work is not used to improve, extend, or “train” our AI engines, unless you explicitly “opt-in” to contribute content.

3.5. OpenAI Opt-in. Your work, when submitted by us to the OpenAI API, is also not used for training by OpenAI, according to their disclosed data usage principles (see OpenAI API data usage policies: https://openai.com/policies/api-data-usage-policies). OpenAI also offers an “opt-in” option. OpenAI also discloses a 30-day maximum storage of submitted data (except as required by law).

3.6. Other Legal Terms. Other restrictions on us with regard to your work, such as that we do not gain any right to retain or publish your work, are described in the Terms of Use.

4. Your Choices and Privacy

4.1. Usage Types. We aim to be transparent and accessible with information about our privacy practices, by making it simple to understand. As such, we have identified different privacy matters depending on the way in which you use our website. This Privacy Policy addresses the privacy issues involve with various different ways that you might use our website:

  1. Basic web browsing (including online advertisements)
  2. Clicking on an online advertisement

The privacy issues of “Basic Web Browsing” and “Clicking on an Online Advertisement” are usually applicable to all types of access, including the other more advanced modes of access of our website. These other modes also have additional privacy issues beyond the basic ones.

5. Basic Web Browsing

5.1. Collection. When you visit our website for “basic web browsing” to view a web page, without registering a user account, there are two main ways that private information may be collected about you:

  1. Our servers may collect information, and
  2. Our partners (such as Google or OpenAI) may collect information.

5.2. Our Servers. In the first case, when your browser accesses a URL, it sends a request to our servers for the web page. This request may contain personal information, as discussed below.

5.3. Partner Servers.Secondly, in responding to your request, our servers may send back HTML codes or scripts to display online advertising or to invoke analytics about your web page visit. When your browser actions these codes or scripts to show online advertising or trigger analytics statistics, our Partners may receive private information from your web browser, as discussed below.

6. Types of Personal Information

6.1. Types of Information. Our web servers are configured to collect minimal private information about you, but our partners may receive more information. When you visit our websites, the web browser typically sends various information about your visit and your device to our web servers. The type of information sent may depend on your device configuration, but can often include:

  1. The URL of the web page being visited
  2. The prior website URL from which you visited our URL (called the “referrer URL”)
  3. Hardware information about your device (e.g. whether it is an iPhone, Android, or PC)
  4. Device-specific identifiers, such as the Android Advertising Identifier or the Advertising Identifier for iOS (Apple iPhone) on mobile devices
  5. Software information about your device (e.g. it’s operating system such as Microsoft Windows vs Apple OS)
  6. Browser software information (e.g. Microsoft Edge, Google Chrome, Safari or FireFox)
  7. Version information about your software or hardware
  8. Your IP Address, which may also indicate your access provider and your location.
  9. Cookies. This is discussed in detail further below.

6.2. Private Information. Some of these types of information may be private information. For example, device-specific identifiers may identify you on mobile devices, and your IP Address may uniquely identify you on non-mobile devices, although this is not always the case. Information about your current URL request, or the referrer URL, may be private information, because the web pages you visit may indicate your preferences, circumstances, or other private facts about you.

6.3. Simple Web Browsing. It should be noted that some types of personal information are not normally available from general web browsing (e.g. email address, phone number, address, name, etc.), although they may be provided as part of account registration, newsletter sign-ups, or other advanced usages.

6.4. Anonymous and Pseudonymous Access. Users may access our website anonymously for Basic Web Browsing, and also for some guest sessions, even where the user may upload a document to be temporarily processed. 7.2. We do not use any Cookies or Super Cookies specific to our website when you access our website for “basic web browsing”. Our guest sessions also use Cookie-less session tracking methods.

7.3. We do use Cookies for user account registration (e.g., login), and paid access purposes.

7.4. Even on visits where we may not use cookies, our advertising and analytics partners typically use cookies when you access our website. Any partner’s use of Cookies is subject to their own privacy policies, rather than this one.

8. Our Minimal Collection of Personal Information

8.1. Importantly, our web servers are configured to record minimal private information about your access in guest sessions or Basic Web Browsing. In particular, in their usual mode, our web servers are configured so as to:

  1. Not store your IP Address to disk log files.
  2. Not store any device unique identifiers in the log files on disk.
  3. Not use any cookies for basic web browsing.
  4. Not use any cookies for guest sessions.

8.2. As such, your personal information is only stored in memory for a short period by our servers, if your only access is for Basic Web Browsing. We have no permanently stored private information about you in this common situation.

9. Partner Collection of Personal Information

9.1. Partner Collection. The second way that private information may be collected is via partner scripts. These may be triggered by your browser accessing our servers, and they can send your private information to our partner servers. Such private information may include any of the types of private information listed above, and may include storing or accessing Cookies on your web browser and/or device-specific identifiers on your mobile device.

9.2. Types of Partners. We have multiple categories of business partners, which typically store additional information about your visit when they are used. These categories include:

  1. Online Advertising
  2. Online Analytics

9.7. Payment Partners. Where you use a paid feature of our services, we process your payment through payment partners. We do not receive a copy of your credit card details or other financial information.

9.11. Clicking on Advertisements. If you click on, or otherwise interact with, an online advertisement, then additional private information may be collected about you by our partners and by the advertiser site you visit. The fact that you have clicked on an ad may be private information as it may indicate your personal preferences or circumstances. Our servers do not receive any information from you about ad clicks in such case, but your data may be sent to the advertising partner, and subsequently to the company that placed the ad.

9.12. Links to Other Websites. This Website contains links to other sites that are not our partners. Similarly, advertisements may link to other websites that are not our partners. Please be aware that we are not responsible for the content or privacy practices of such other sites. We encourage our users to be aware when they leave our site and to read the privacy statements of any other site that may collect your private information.

10. Why Do We Collect Private Information?

10.1. Firstly, we try not to, by collecting minimal information, as discussed above. However, in general, our website and our partners may use your private information for reasons such as:

  1. Providing you with the service you requested (e.g. processing of a file you have uploaded).
  2. Showing you relevant online advertising (e.g. Google advertisements)
  3. For credit verification of your payment for any paid services.

11. Where Do We Store Your Private Information?

11.1. Storage. As discussed above, we often do not store any of your private information. For example, the architecture for many of our tools involves memory-only processing of your uploaded files and/or automated removal of temporary uploads, although our advertising and analytics partners may collect private information even in such cases. However, there are various other circumstances where we may store your personal information, such as user accounts.

11.2. Location of Our Servers. The specific server that you access depends on various aspects, but may be in the USA or Canada. Our technology partners may include:

  • Amazon AWS – servers located in the USA.
  • OVH —servers located in the USA.

11.3. USA Processing. Your private information, such as user account registration information, typically remains on our servers in the USA.

11.4. USA Partners. All of our main partners are located in the USA, and should typically process your information in the USA, although you should confirm this by reviewing their public privacy disclosures. We only transfer private information to international companies with well-defined privacy practices and clear privacy policy documentation, including clear disclosure of collection and use of private information, and procedures for complaints, request handling, and other requirements of the relevant privacy legislation or of legislation that is substantially similar.

11.5. Server Log Information. We do not transfer “log files” of hardware servers to a different location, so information from Basic Web Browsing will not be transferred.

11.6. Backups. We may maintain backups of user account information, email newsletter registrations, contributed content, or other important user information, that may contain private information. These backups may be stored at the server locations (typically in the USA) or at the Head Office.

12. When Do We Disclose Your Private Information?

12.1. No Sale to Third Parties. We do not sell or transfer any private information, that we have collected and stored in our servers, in the ordinary course of business.

12.2. No Spam or Direct Marketing. We do not sell your private information to any third parties. For example, we do not sell email addresses or other private information to “spam” marketing agencies or “direct marketing” companies.

12.3. Partners. Although we do not explicitly disclose or transfer any private information we have stored on our servers, as already discussed, our partners may collect and retain various private information as a result of your use of our Website or Services, as discussed above.

12.4. Business Transfer. We may disclose, transfer, sell, or otherwise handle your private information, as the result of a proposed or completed corporate transaction, such as a sale of assets, sale of stock, merger, acquisition, internal restructure, or similar corporate transaction.

13. Guest Sessions; Uploading Your Content to Our Website

13.1. Guest Sessions. A guest session is the usual “Basic Web Browsing” of our website, but where you also either (i) upload content to our website or (ii) otherwise start a multi-page session.

13.2. Cookie-less Technology. Our technology uses Cookie-less session codes for guest sessions, although our partners may still use cookies in such sessions.

13.3. Uploading Content. If you upload your content to be processed by our tools (e.g. a written document, a code file, an online form, an image, a video, etc.), as a guest, then we have obligations to protect any private information it may contain. In such a guest session, our default architecture involves processing uploaded content in temporary memory and automated removal of temporary files and reports.

13.4. Derivative Reports. In some cases, where the original user file is not stored, the tool may still create internal representations, reports or other derivative analysis of your content, which may contain excerpts of your work, that is then stored to disk. The reason to store these reports to disk is to use these files to show subsequent pages in a guest session. If such internal representations or reports are stored in a guest session, they will be removed within a reasonable time period after the session, usually 24 hours.

13.5. Other Architectures. Not all tools can use this architecture with content processed in memory for guest sessions, and our individual web pages and tools may contain additional information describing the privacy practice of that specific tool. In cases where a temporary copy of your content is retained in a temporary disk file for a guest session, our policy is to remove it in less than 24 hours.

13.6. Licenses. In addition to privacy issues, there are other legal issues regarding your uploaded or submitted content, including that your copyright is not transferred to us, but that you may grant us a limited license to use your content (e.g. to show you a report), and restrictions on when we can or cannot retain a copy of your content. 14.2. Uploaded Account Documents. If you upload content to your own registered account, it must obviously be retained by our servers for a longer period so that you can use it in your account. A document does not become “shared” or “contributed” merely by virtue of your uploading it for processing by our tools, and your affirmative opt-in agreement is required.
